ARTIST ACKNOWLEDGMENT AND AGREEMENT

Exhibition Participation

BHAC membership provides access to exhibition opportunities but does not guarantee acceptance into or placement in any exhibition. Each exhibition may have additional eligibility requirements, deadlines, fees, commission terms, and participation conditions.

If accepted into an exhibition, the Artist agrees to deliver exhibition-ready artwork by the stated deadline. Artwork must remain on display for the full exhibition period unless Bee+Hive Artist Collective (“BHAC”) or the exhibition venue provides prior written authorization for its removal.

Attendance at exhibition openings and related events is encouraged unless participation is specifically required in the applicable exhibition terms.

Originality and Ownership

The Artist represents that all submitted artwork is their original work and that they own or control the rights necessary to exhibit, promote, and sell it. The Artist is responsible for obtaining permission for any copyrighted, trademarked, or otherwise protected material incorporated into the artwork.

Artwork created entirely by artificial intelligence is not eligible. AI-assisted elements may be considered when incorporated into a larger original work created through the Artist’s own substantial creative contribution. Final eligibility is determined by BHAC.

Artwork Preparation

The Artist is responsible for ensuring that accepted artwork is properly prepared, securely framed or finished when applicable, and ready for safe installation. BHAC or the venue may decline to install artwork that is unsafe, unstable, improperly prepared, or inconsistent with the exhibition requirements.

Artwork Insurance, Custody and Risk of Loss

The Artist retains ownership of and responsibility for their artwork at all times. BHAC and participating venues do not provide insurance for artwork or other personal property belonging to the Artist.

The Artist is strongly encouraged to maintain appropriate insurance covering loss, theft, damage, transportation, installation, exhibition, storage, and return of the artwork.

BHAC and the participating venue will exercise reasonable care when handling artwork. To the fullest extent permitted by law, neither BHAC nor the venue will be responsible for loss, theft, or damage except to the extent caused by that party’s gross negligence or willful misconduct. Nothing in this agreement excludes liability that cannot legally be waived.

Artist Responsibility and Indemnification

The Artist accepts responsibility for claims, losses, or damages resulting from the Artist’s breach of this agreement, violation of another party’s rights, or negligent or intentional conduct.

To the fullest extent permitted by law, the Artist agrees to indemnify and hold harmless BHAC, the participating venue, and their respective owners, officers, employees, contractors, and agents from third-party claims arising from such conduct. This provision does not require the Artist to indemnify any party for that party’s own gross negligence, willful misconduct, fraud, or violation of law.

Photography and Publicity

The Artist grants BHAC and the participating venue a nonexclusive, royalty-free license to photograph and reproduce images of the Artist, the Artist’s submitted materials, and exhibited artwork for purposes related to the exhibition, BHAC programming, publicity, education, social media, press, and historical documentation.

The Artist retains all copyrights and ownership rights in the artwork. BHAC may retain previously published materials and exhibition documentation in its archives after the Artist’s membership or exhibition participation ends.

Artwork Sales and Commission

Unless otherwise stated in writing for a specific exhibition, the Artist will receive 60% of the final artwork sale price. The remaining 40% will be distributed among BHAC, the participating venue, and any applicable curatorial parties according to the terms of that exhibition.

All exhibition sales must be processed through the designated sales system. The Artist will receive the applicable sales and payment terms before participating in an exhibition. Any change to the Artist’s percentage must be disclosed in writing and accepted by the Artist before the artwork is exhibited.

Removal and Collection of Artwork

The Artist is responsible for collecting unsold artwork within the designated pickup period. Artwork may not be removed before the exhibition closes without prior written approval.

Any storage fees, extended custody terms, or procedures for artwork not collected by the deadline must be stated in the applicable exhibition agreement or pickup notice.
